Ken trading lost out against Panerai as their watch was a blatant copy of the Luminor, but what interests me is that RWC(retrospect watch company) were never taken to court with their Cali dialled Radiomir homage and have produced 2 models of that watch and were producing the Egliziano before panerai re released it. i owned an RWC 1938A and loved it as i love the california dial, which was used by many brands, but could never afford to buy a panerai version. i dont know any of the legalities, but i 'think' the radiomir case has no patent in place anymore, the california dial was never under patent and the movement is well... the movement.
i detest blatant fakes, but if a company will go to all the effort of making good quality watches paying homage to other historic brands whilst making it plain that they are homages then that is a very different matter.
what about brands like Ocean 7?
