I'm no copyright Law expert, but for starters, I'm pretty sure that the injured party needs to sue here (and because of the fine print you saw on the company's site, that's likely only Audemars Piguet or Seiko -- not a customer).

In a few weeks from now, we'll know more about the limits (or lack thereof!) of the First Amendment when it comes to copyright Law. And (to simplify just a little) after "Bad Spaniels" gets decided, it might be enough for these people to find the name "Casioak" funny to keep using it... But I still can't imagine that, even under the VERY broad free speech protections granted in this country, you can put "Seiko" on the dial of a similar monstrosity and get away with that!
