It’s the same bird, a red-tailed hawk
Here is the context of the photos - I was standing looking straight up and revolving in a circle catching about 20 photos of the hawk (and almost falling from dizziness) I think he was performing for me as he clearly knew I was under him.
Hard to believe that I could see him first with the naked eye but this wide view and tiny dot shows the hawk on the branch, a few hundred yards away from me:

Only about 5 minutes later did I see him soaring -- it looked like he was going after the boat.
