what did they steal? I think there are similarities in the case but can a company trademark or patent a shape? Just imagine if a company had the exclusive rights to a certain case

shape (round). 

Incidentally I think that there are many rolex inspired timepieces everywhere (think submariner..). To me there are major differences here: this is a mechanical watch not a smart watch so
it wouldn't be like samsung copying the shape of the iPhone case or iwatch.  The case might be patented but that will have to include some novelty e.g. the sensor on the back case, the crown etc. all
features that are not present in the moser watch.

Moser did have a rectangular watch (and movement) well before the iPhone so just changing the case size slightly shouldn't really be a steal... 

Legal issues aside (I am no intellectual property expert but I can tell you that the patents law in the U.S. is very different to Swiss law)  I feel that there is some innovation here: who would have thought that a watch with a similar shape of the apple watch can be so cool ?  Let's not forget the square movement (not another solid caseback with a tiny round movement inside).  

If Apple wishes (and manages) to stop this watch it would be sad for the industry. It would mean that no other square watch with a similarly sized case could ever exist?!
