really curious about the legal case...

 

I am a lawyer (but not specialised in intellectual properties not a patent attorney) and i was intrigued by the claim of a swiss patent attorney on a local newspaper that Apple could have a claim for the design. Highly doubtful because the only similarity is the case and -- as you point out -- the case back is entirely different. I even think the only similarity will be the shape as the apple watch crown position and the curves might be different to the moser watch.  I would be very surprised if Apple would have a case -- at least here in Switzerland. 


I don't know much about patents but I doubt a case can be patented in Switzerland unless it has a new functionality. Three dimensional trademarks are tricky: in one instance it was accepted in Europe (Lindt easter bunny with the golden bell) but I don't think this would be the case.   Obviously Apple has enough lawyers to sue and find the relevant grounds but Moser might then get even more publicity: David v. Goliath fight?
