Hi Nicolas! Happy New Year! Wish 2016 will be a wonderful year for you & your family! some of this past issue will get resolve soon!!! I went to the HK police & explained your situation. Here is what they said:
1.) They think the auction house should not had given the watch back to the consignor if they knew it was a stolen goods. However, even your document suggests you could be the original owner of the goods, the consignor also is the owner of the goods from the auction house point of view. What they should have done is to contact the local Police the moment they found out the goods was stolen & see what the Police will suggest them to do. Of course the auction house may be following their Company procedure by giving back the watch to the consignor but still the key point is that if they know it is stolen good, they should have informed the Police!
2.) Since there is no proof of any criminal act, the local police cannot do anything at this point except for putting your case on local file.
3.) They suggest to settle this through Civil action. Basically sue the auction house for your lost. Of course even if you win, it doesn't mean you will get back your watch! Instead getting the monetary equivalent. If the auction house chooses to involve the consignor, then it will depend on how the consignor does! In this case, I guess the Consignor also needs to prove ownership!!!
